When you use our services, we collect personal data about you. The purpose of this privacy policy is to expose users of the:

1.1. ABOUT NEOVIGIE

The NEOVIGIE application is developed and marketed by the company NEOVIGIE. The company NEOVIGIE owns and operates the website and the mobile application NEOVIGIE.

For the purposes of this Privacy Policy, we use the term "Service" to refer to the services we provide in connection with the application and website.


1.2. GENERAL DEFINITIONS

General Data Protection Regulation (GDPR): Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

1.3. IDENTITY OF THE DATA CONTROLLER AND PURPOSES

The data collected via the NEOVIGIE application is subject to processing for which your employer is responsible under the applicable regulations of the USA.

All the information collected through the NEOVIGIE application is only collected by your employer in order to ensure the safety of its employees.

The processing of your data in this way is necessary for the performance of the contract you have concluded with your employer and for the pursuit of your employer's legitimate interests in ensuring the safety of the employees under his care, to the exclusion of any permanent monitoring of the employees.


1.4. PERSONAL DATA COLLECTED

We collect and store personal data about you that you communicate to us when you use the NEOVIGIE application.

When you create a NEOVIGIE account, the following information is collected:

  • Identification data: surname, first name, email address, contact details (telephone and email), postal address.

In addition, in order to provide the expected service, the application also collects the following data:

  • Location data: GPS coordinates (longitude and latitude)
  • Location data: Indoor positioning with Bluetooth tags
  • Alert in case of loss of verticality, absence of movement, anti-tearing, Geofencing
  • Trip history

1.5. DATA SHARING

Except as noted below, we do not share or sell any data that identifies our users or allows third parties to contact them directly.

1.6. THE RIGHTS OF THE PERSONS CONCERNED

You have a right of access, rectification, opposition, limitation of processing, portability and deletion under the conditions provided for in Regulation 2016/679 of 27 April 2016. You also have the right to define guidelines regarding the fate of your personal data after your death in application of the Law for a Digital Republic n°2016-1321 of October 7, 2016. 1.7. DATA PRESERVATION

NEOVIGIE will retain your profile information for as long as your account remains active, unless you request deletion of your profile information or your account.

As far as your geolocation data is concerned, we keep them in principle for 2 months. However, they can be kept for a period longer than two months if :

  • A specific regulation provides for it
  • Such retention is made necessary for purposes of proof of performance, when it is not possible to provide such proof by any other means.

In the second case, the retention period is set at 1 year, this period not being an obstacle to a longer retention period in the event of a dispute over the services provided.

Finally, in some cases, we may retain information about you because of the law or for other purposes, even if you delete your account. The data used to establish proof of a right or retained in compliance with a legal obligation, may be subject to a policy of intermediate archiving for a period corresponding to the legal prescription periods (and in particular the common law period of 5 years).


1.8. DATA TRANSFERS OUTSIDE THE EU

All the servers on which your data is kept and stored are located in Europe.

In the event that NEOVIGIE uses subcontractors located outside the EU, we undertake to ensure that the subcontractors present appropriate technical and organisational measures so that the processing meets the requirements of this Regulation and guarantees the protection of the rights of the data subject.


1.9. THE SECURITY IMPLEMENTED TO PROTECT THE DATA

As you would expect, NEOVIGIE takes the security of personal data seriously. Our risk management and security controls include:

  • Integrate data confidentiality from the design stage in everything we do;
  • Internal access control based on role and least privilege: all accesses are logged;
  • Risk management, business continuity, including disaster recovery, backups, business impact assessments, risk logging and data protection impact assessments;
  • Data breach management: NEOVIGIE will notify all users affected by a data breach within 72 hours;
  • Cryptography; encryption controls, key management;
  • All data is saved;
  • Secure and alarm the company's premises;
  • Asset management ;
  • Network segregation, penetration testing and a software development cycle.

1.10. COMPLAINTS AND QUESTIONS

You may exercise your rights in accordance with the regulations in force. This Privacy Policy is subject to change, NEOVIGIE reserves the right to update or modify it at any time and without notice.

You are therefore advised to consult it regularly. Your continued use of our services following any changes to this Privacy Policy constitutes your acceptance of those changes.
