Yukon Businesses: Enforcing the Yukon Occupational Health and Safety Act (OHSA)

Is isolated work allowed in Yukon?

Yukon businesses are subject to The Occupational Health and Safety Act from Yukon. Yukon's LLST does not prohibit isolated work. However, he must ensure that:

  • “the workplace, the machines, equipment and processes for which he is responsible are safe and without risk to health;
  • working techniques and methods are adapted and implemented in order to prevent or reduce the risks of occupational injuries;
  • workers receive the necessary instructions and training and are well supervised, taking into account the nature of the work and their abilities.”

Can an employee refuse dangerous work?

Section 15 of the Occupational Health and Safety Act allows a worker to refuse to do work if the worker has reason to believe that:

  • “the use or operation of a machine, device or object constitutes an unjustified danger to himself or to any other person;
  • there is unwarranted danger in the workplace.”

Is it mandatory for Yukon businesses to have a alert device equipped?

The LSST states that employers must take a series of precautions to protect workers. It is up to the employer to take the measures it considers reasonable to ensure the safety of employees working in isolated environments.
